2. Ken Penders sued Sega in 2011, under the belief of "original character, DO NOT STEAL!", because the Nocturnus Clan were carbon rip-offs of the Dark Legion (eg. Shade is Lien-Da/Julie-Su, Ix is Finetivius) making any chances of the sequel still happening under a different developer squashed.
3. According to Ken Penders on Thanks Ken Penders on Tumblr, Ken Penders has stated that the characters from Sonic Chronicles are never going to appear again. Because, if Sega uses any of them, THE STATUE OF LIMITATIONS WILL BE REOPENED, GIVING KEN PENDERS ANOTHER CHANCE TO SUE SEGA.
So, regarding the Archie reboot, since they had to get rid of all of Penders' characters, because the settlement between the case between Archie and Penders allowed the former to use the latter's characters, but only if they paid royalties and followed Penders' guidelines.
How were characters not owned by Penders wiped out as well?
